Addressing Power Imbalances and Bias in Employment Mediation

Session Description:

Employment disputes present classic power imbalances. The session will identify strategies to overcome such imbalances by exploring the following approaches: the availability of information, the use of subject matter experts, the inclusion of non-legal “support" participants, and the structure of employment dispute resolution processes. The session will pose ethical considerations and discuss whether the individuals with less power do better in a voluntary negotiated process or in litigation. Lessons learned can be used to improve employee/employer relations beyond the dispute resolution proceeding.
